These terms and conditions clarify the Owner’s obligations to the Renter, the Renter’s obligations to the Owner and, in the highly unlikely event of disputes, will be used as the basis for any resolution. Please read them carefully before confirming your reservation.

All rates are in US dollars.
Add a 15% government tax and a $10 cleaning fee per day.
In low season, an earlier check-in and a later check-out are possible (please inquire for details).
Acceptance of these terms and conditions binds a contract between the following two parties:
The rental applicant and the landlord.
1. Party members
All persons listed in the rental agreement or subsequently added by the tenant will be bound by the terms of this agreement. Occupancy of the property is restricted to the names listed in the Agreement or later added by The Renter. The rental applicant is considered to be the primary tenant and will assume full responsibility for all members of the rental group during the rental period. Information or instructions related to this rental will be communicated only to the Applicant for the rental and not to any third-party member of the Rental Group.
2. Payments
The owner will confirm the reservation once the request has been approved and the initial or full payment has been processed. In the event that the owner does not accept a reservation, all fees paid will be immediately refunded. No reservation can begin without full payment being cleared. Any missing, damaged or broken items will be deducted from your deposit and the balance will be returned to the renter. Once the owner receives and accepts the reservation, the renter is responsible for paying the balance of the fee prior to occupancy of the property. Failure to pay before the due date will be treated as a cancellation and the deposit will be forfeited.
CANCELLATION AND CHANGE OF RESERVATIONS POLICY
Once a reservation has been accepted and confirmed, a cancellation can only be made in accordance with the terms below:
· Any cancellation made more than 30 days prior to arrival date will receive a full refund of any rental money collected in advance.
· If the cancellation is made within 15 days of the rental occupancy, the Renter will lose the 50% paid for that period, and we will work with you to reschedule your vacation stay with us at a later date.
· Any cancellations made within 7 days of your arrival date will forfeit any rental amount charged.
· Cancellations must be made during rental service hours, Monday through Friday from 8:00 am to 5:00 pm | Saturday from 10:00 am to 3:00 pm.

4. Property occupation
Regardless of the published maximum number of people a property can accommodate, the number of guests occupying the property is strictly limited to the maximum number indicated. The declared and agreed occupancy figure includes all persons regardless of age, day and overnight guests.
Exceeding the number of people indicated and agreed will result in an extra cost without exceptions.
5. Property status
The property will have been inspected prior to occupancy and, therefore, the tenant agrees to:
- Notify the owner immediately regarding any damage and / or maintenance problems that require attention.
- Maintain the property and all furniture, accessories and effects in or around the property in the same state of repair and condition as at the beginning of the rental.
- Where a cleaning service is not provided; The Lessee must leave the Property in the same state of cleanliness and general order in which it was found. Failure to do so to the owner’s satisfaction will result in a damage / cleaning fee.
6. Pets
Pets are strictly prohibited on this property. Any evidence of pet occupancy will result in forfeiture of the damage deposit in full.
The owner does not accept any responsibility for any allergic reaction or other conditions arising from the occupation of the property. The “No Pets” designation does not indicate that there were no pets on the property at any time.
7. Smoking
Smoking is not allowed in the home or in the vicinity of the apartment entrances. If there is evidence of smoking in or around the property (cigarette butts included), $ 100.00 will be withheld from the renter’s damage deposit.
8. Equipment and facilities provided
Equipment and facilities are provided at the owner’s discretion and, while every effort is made to ensure that such equipment is in working order for the rental period, in the event of a breakdown or other disabling situation a non-essential item, the owner does not assume the responsibility to replace or reimburse the lessee for the lack of use of this equipment or facilities. The equipment and facilities mentioned include (but are not exclusive) elements such as: Televisions, Wi-Fi, Microwaves, etc.
The Renter must inform the Owner of any defective or inoperative equipment immediately. The landlord will make every reasonable effort to have repairs made as soon as possible; however, there are limited service contractors as Roatan is a small island with limited access. While every effort will be made to ensure that all advertised equipment and appliances are working properly at the beginning of the rental period, there will be no rent reduction; refund; or a refund will be issued for a mechanical failure of the air conditioner, TV or other appliances.
9. Refunds
If critical items such as water, plumbing and electrical systems, and major appliances such as a stove or refrigerator break down, every effort will be made to repair or replace it, or a corresponding refund will be made for the inconvenience caused. This does not apply to system breakdowns caused by misuse, such as blockages in pipes caused by improper use of sanitary facilities.
The Owner is not responsible, nor will it provide a refund, for any interruption of electrical services caused by extreme weather conditions or other circumstances beyond its control. Similarly, no refunds will be made for inclement weather, hurricanes, storms, terminal closures (Air / Maritime), conditions in neighboring properties or any discomfort caused by the natural elements of the place, such as flying insects or the animal population.
LIMITATIONS OF LIABILITY:
The lessee declares, guarantees, acknowledges and accepts with the owner that he/she will use the property and its facilities in accordance with the above terms and conditions and the information provided and that he/she does so at his / her own risk and that he/she indemnifies and saves the Owner from any personal injury, illness or death, loss or damage, whatever its cause, to the person or property of the Renter, his family or guests, before, during or after the time of occupation. In addition, you accept full responsibility for the use of the Property and any recreational equipment such as electronics, etc. and you agree to pay for any damage to such equipment, except normal wear and tear. The lessee further acknowledges that they are responsible for ensuring that all community standards are followed.
Rental apartments must be locked (including all windows and doors). If there are stolen items that are not insured or left unattended, the owner will not be responsible. Security is strictly enforced.
